Kündigung (I LEAVE GERMANY!!)

Hi, we gave notification via email THREE MONTHS in advance that we wanted to cancel the contract for Festnetz because we are leaving Berlin, and you confirmed on the phone that our last day of the contract was 30th of September. Now I receive a kündigung letter saying that you will cancel on October 31, and that I need to pay one more month even if I am already NOT LIVING IN BERLIN. I need an URGENT letter confirming that my last day of contract is September 30th, as you told me on the phone, because that is my last day in Berlin and because I already gave THREE months in advance notice. I need an URGENT ANSWER.

      otherwise Telekom people do not have an insight in your customer data.

       

      Just a hint: if you cancel the contract on June 30th latest then the end of the contract ist September 30th. If you do it on July 1st then the end of the contract is October 31st.

       

      This proceeding is governed by German law.

       

      No matter whether September 30th or October 31st you should keep you bank account because financially the final invoice where there usually is a refund will not be September 30th or October 31st - but could be one or even two months later.

      I do not have insight in your communication with Telekom as I am not working for Telekom.

       

      But I can tell you few things for sure out of my own experience:

      1. German law looks at the date when the message is received rather than when it is sent
      2. Many emais reach the destination within seconds or minutes after sending - but there are others that are stuck somewhere and arrive with a delay of hours or days - or will even never arrive
      3. The "sent" date in your email account in such case may hence well deviate from the date shown to Telekom - it's a time stamp mess with emails

      I have taken a look at the facts. I will now cancel the existing termination and it will be set again to the end of September 2016. You will then receive a new letter of confirmation. I am glad that I could help you  and I wish you a good time in Argentina.
