Title: Deceived by shop employee in Schwäbisch Gmünd due to language barrier – 24-month contract hidden
vor einem Monat
Hello Telekom Hilft Team,
I am an international resident and I urgently need your help regarding a critical issue with a contract set up at a physical retail store.
On 12.09.2026, I visited the Telekom Shop in Schwäbisch Gmünd (Bocksgasse 13) to get a fiber internet connection for my new apartment. Because my German is limited, I explicitly asked the employee if he spoke English. He nodded, but unfortunately, he used the language barrier to deceive me into a bad contract.
The employee checked my address and told me Glasfaser would not be available until 01.02.2027. I explicitly told him I needed a temporary, flexible solution until that date. He recommended "MagentaZuhause L mit MagentaTV". I asked multiple times if this was a temporary solution that allows an easy transition to fiber later. He said "Yes" repeatedly and told me to just come back to the store to change it.
When printing, I noticed MagentaTV and stated clearly I did not want TV. He misled me by saying a €100 router discount would balance it out, completely hiding that he was locking me into a rigid 24-month minimum term (Mindestvertragslaufzeit).
The next day, I contacted Telekom Live Chat support, and the online team confirmed via email that the shop had sold me the entirely wrong product—they stated I should have been given "MagentaZuhause Sofort" instead of a 24-month fixed contract.
I went back to the store on 16.09.2026 and 17.09.2026 to fix this mistake. The employee and his colleague were incredibly hostile. They refused to listen, said "it's your fault for signing," shouted that they don't care what the online live chat says, and refused to let me speak to a manager or give me a name/email. I left the signed contract copy there with my phone number, but they never called back.
I am formally contesting this contract under German Civil Code § 123 BGB (Avoidance due to deception) and § 119 BGB (Contestability due to error). I have already filled out my Customer Number and Order Number in my private profile settings.
Could a team member here please review this case, look at my online chat history notes, and help me cancel this fraudulent shop contract? I am feeling very stressed and unwelcome by how this store treated me.
Thank you so much.

Unfortunately, the team cannot do anything in this case. There is no right of withdrawal for contracts concluded in the store. Please contact the store to see if they will make an exception as a gesture of goodwill.0

As stated in my post, I have been to the store multiple times and all I got in response was derogatory remarks. Telekom being the largest network provider in germany cannot provide me a proper solution. Perhaps should I consider contacting the "Verbrauchzentrale" ?

@olliMD , I know the officail language is German and the contracts are also concluded in German. Please read my comment properly. The responsibilty that I mentioned is the the "responsibility to sell a correct/right product which is requested" not the responsibility for a language barrier. So Yes, Telekom should be responsible to sell me a right product.

It’s the solution because the shop is responsible for it—even if you don’t want to admit it...

What is a "SHOP" ? Is it not from TELEKOM ? It is very inappropiate that you want me to admit the solution. Is this the only way how things work? if you believe that this is the kind of support you can provide then YES I admit that I am very sorry and disappointed in telekom.

I am sorry for your experiences which should not be that way. Anyways, I am wondering about your concerns you have at this time. Once fiber is set up you’ve the option to make an upgrade despite the contract term of your recent connection. Please note as well that fiber connections are only available with a minimum term of two years, beginning at the time of setup. Further please keep in mind that in case you move somewhere else you have the right to cancel the contract if the same connection cannot provided at your new residence. Though it looks like you’re locked up at the moment in a two years’ contract you still have flexibility if certain circumstances are changing.

This is from my contract "Jederzeitiges Kündigungsrecht bis zur Bereitstellung als Verbraucher
-------------> please answer my question, Don't I have the right to cancel my contract since it is not yet activated?

@twnkle In your case you made a binding contract in the shop that means there is no 14-days grace period. And according to my knowledge the passage you are referring too is for situation that take longer then promised to provide an internet connection, but feel free to seek a second opinion.
Kind regards
Sören

The above is not a "Widerruff" I assume but a contractual cancellation right. Maybe you are confusing with the usual 14 day cancellation period with this which is mentioned in my contract specifically. or If i'm wrong please explain me in detail.

Hi @twnkle,
firstly I need to say, that @Marcel2605 is right. In cases like this there is no 2-week right of withdrawal. Formally contesting the contract according to certain laws concerning fraud would be a different legal matter, which cannot be handled here in the forum.
Anyway, maybe everything is not quite as dark as it seems. Because normally, if you order a fiber contract which still needs to be physically built, the intermediate DSL contract gets cancelled as soon as the fiber contract starts. This is the case if both contracts are connected to the same customer number.
This raises the question why the contract was meant to be flexible, because as soon as the fiber connection is established, a new fiber contract (normally with a 24-month minimum term too) will start anyway. And the DSL contract will be replaced by the fiber contract, so an intermediate contract would get cancelled. On the other hand, a contract with another provider would just be an additional contract.
But of course, you are free to seek independent advice from the Verbraucherzentrale, too.
Sincerely,
Johannes P.

@Johannes P.
I did not say that @Marcel2605 was wrong in his answer. I was pointing him that certain FRAUD had happened. He mentioned that contacting the store might make an exception out of GOODWILL. To which I said All i got in response was derogatory remarks.
To your response:
Firstly Thanks for elaborating your answer.
I went to the shop to order a fiber contract. But Clearly I ended up with a VDSL Magenta Zuhause L mit magenta TV inlcusiv. Is this a flexible contract?(because in the contract it says 24 months). Does this contract act as an intermediate contract and gets cancelled after the network is physically built?
Even once the network is physically built, I did not want to pay extra for Magenta TV which was added as an extra?

Thank you very much for your follow-up message. 🙏
I can certainly understand your frustration, but we are unable to verify the situation that occurred at the physical store. You actively chose to sign a contract there, which is why there is no legal cancellation period at the store. 🙏
We have no authority to intervene in the contract, which is why the only option is to resolve the matter in person at the store.
Best regards
Timur

"noch keine Leitung für Ihr Wunschprodukt vorhanden"
This is what it say in the Zwischeninformtion document that I received.
As I pointed out several times and added the pictures, I have a contractual right to cancel the contract without any reason no matter if i signed it in the store or ordered it via online. Please read the terms and conditions:

Hello,
You will need to clarify this matter directly with the Telekom shop where you ordered the connection. For contracts concluded in a physical store, there is generally no statutory right of withdrawal, so any solution would have to be handled as a matter of goodwill (Kulanz) by the shop.
I'm sorry, but we are unable to resolve this directly here.

@*Paz Vizsla* , Could you kindly provide me a context of how I can explain it to the store when the employee is not even allowing me to talk to the store manager? How can someone initiate a GOODWILL talk if they are not given a chance?

One thing need to say after all: What happened to @twnkle is somehow common practice. The target ist always to sell whatever brings most money to the company, matters not if the customer is in need for that or not. This happens at the doorstep, in the shop or on the phone. The consultation is often not based on the needs of the customer. By law the customer signed his order and it is valid but by moral this kind of business has an off-taste.

@Marcel2605 and Magenta TV is great or not doesn't matter to me as I specifically don't need it. Instead of advicing me to learn my lessons (which I will for sure hereafter), please have a sense of accountability towards a wrong doing/doer.
"Das Ziel ist immer das zu verkaufen was dem Unternehmen am meisten Geld einbringt, da ist es egal ob der Kunde es braucht oder nicht. " @andiling thanks for mentioning. This is what was happened in my case afterall I suppose.
Why would someone need to sell me an Apple when I asked specifically for a Banana?

Even if it sounds harsh, you bear some of the blame too.
You simply signed blindly, without reading.

Even if it sounds insecure or harsh your employee sold me a wrong product and you are blindly supporting your employee who sold a incorrect product.
I see that you have a sort of convenience to put some blame on me, instead of taking accountability which ofcourse is of no interest to you or the company I guess.

again:
We weren't present for the conversation. Apparently, there were communication issues on both sides. As things stand, no one here can help you. And a piece of well-meant advice is simply this: you shouldn't sign anything until you know exactly what you're signing.
Chalk it up to a lesson learned.
