Does my 14-day right of withdrawal lapse due to number porting, or why can't my contract be adjusted to the new, cheaper tariff?
vor 6 Stunden
Hello everyone,
I recently signed a new internet contract with you through the comparison portal Verivox. Just one day after signing up, the same tariff was offered at a lower price elsewhere.
I then contacted your hotline and asked if my contract could be adjusted to the new, lower price. However, I was informed that this was not possible and that cancellation was also out of the question, as my landline number had already been ported from my previous provider to you.
This surprised me somewhat, as I understand that, according to Sections 312g and 355 of the German Civil Code (BGB), I have a 14-day right of withdrawal for distance contracts (e.g., contracts concluded online via Verivox). As I understand it, this right should generally still apply, even if services have already begun. In this case, according to Section 357 of the German Civil Code (BGB), only pro-rata costs for services already rendered could be charged.
Therefore, I don't quite understand why neither an adjustment of my contract to the currently cheaper tariff nor a cancellation within the 14-day period is possible.
Therefore, I currently don't fully understand why neither an adjustment of my contract to the currently lower price nor a cancellation within the 14-day period is possible.
Could someone from support or the community please briefly explain:
• Does the right of withdrawal actually lapse if a number porting has already taken place?
• If not, why can't my contract be adjusted to the currently cheaper tariff?
• What options do I have in this situation?

Hi @Shabih Ul Hassan,
without having access to your customer account it is hard to give a proper statement.
Regarding the second point not all special prices can be just adjusted in the running order. Some are excluded by the date of booking or the department which has access to said offer.
I will gladly look into this issue. To have access to your order a quick call and verification is needed.
When would you be avaiable for a short call?

Warum schreibst Du Englisch wenn Du doch das BGB offenbar lesen und möglicherweise verstehen kannst?
Warum schreibst Du nicht die key facts, die relevant sind - die fraglichen Daten wann was war?

Given you‘re eligible to withdraw from your agreement of contract I guess no one wanted to hinder you of doing so. However, complications may arise with your phone number. You should keep this in mind and think carefully if this is worth saving some small money. Generally, you own no rights on a specific phone number and you may end up with a temporary disruption or losing the number.
There‘s no regulation price adjustments need to be made. This may be even not possible as there may be different arrangements between Telekom and Verivox or elsewhere. Your only way is to cancel the order through Verivox and go elsewhere if you insist on the cheaper price and accept difficulties. Telekom will honor then elsewhere and not Verivox.
