Intenet contract cancellation - need for English support call

Hello,

I am currently looking to terminate my ongoing internet contract.

I am moving from my current apartment to a AirBNB then I will move in a sub rental apartment for a limited time before leaving the country.

The tenant of the apartment does not want to have changes on the wifi and network of his apartment since he is still using it from a separate office.

Would it be possible to have a call with an English support to solve this issue,

      Thank you for your call @Khaled A. 

      As exchanged I will share with you my new registration that will confirm my move to the new city in Germany associated with the contract I shared with your team last week.

      It will be the proof that I have relocated in Germany but in a temporary serviced apartment without possibility to use my own internet contract.

      Please let me know if I missed anything from our exchange.

      I will shared the anmeldung from the week of the 15th of December.

      thank you very much for your response. Paragraph 46, subsection 8 of the TKG does not exist. The case of moving home is regulated in Paragraph 60 of the TKG . Section 2 states: 
      "Wird die vertraglich geschuldete Leistung am neuen Wohnsitz nicht angeboten, kann der Verbraucher den Vertrag unter Einhaltung einer Kündigungsfrist von einem Monat kündigen. Die Kündigung kann mit Wirkung zum Zeitpunkt des Auszugs oder mit Wirkung zu einem späteren Zeitpunkt erklärt werden."

       

      However, since the service can also be provided at the new place of residence, there is no right to an early termination in this case.

      Dear @Jonas W. 

      Thank you for your response regarding § 60 TKG . However, my situation falls under § 314 of the German Civil Code (BGB), which permits contract termination when continuing it becomes unreasonable due to circumstances beyond my control.

      In my case:

      • Impossibility of Use: My sublet agreement already includes internet access (provided by Vodafone), and the main tenant has explicitly refused any changes. As a result, I am unable to use my Telekom contract at the new address. Additionally, I’ve checked the building and floor—there is no fiber-optic infrastructure available (though this is a secondary point)
      • My understanding from the § 314 BGB is that German courts and consumer protection organizations, such as the Bundesnetzagentur and Verbraucherzentrale, consistently recognize that tenants in sublet or shared housing—where internet is included in the rent—have the right to terminate their contracts under § 314 BGB if they cannot use the service. This is because:
        • I am already paying for internet as part of my rent.
        • I am not permitted to install or use a second connection (your service) due to the main tenant’s refusal.

      I hope you can appreciate that, in this situation, I would effectively be paying for a service I cannot use until I leave the country—unless Telekom can offer a valid alternative for early termination.

      I would prefer to resolve this amicably, but if necessary, I will escalate the matter to the Bundesnetzagentur and provide all relevant correspondence as evidence.
