Early Handy Contracts Termination

vor 7 Monaten

I would like to get information about how to terminate early 4 mobile contracts because I got the following false information points from a Telekom sales person in Darmstadt:

1. I did ask serveral times if the calls to Spain were included in the plan and she confirmed that calls to any country in Europe were included with no cost. From my invoice, I got to know that this is not correct - EU calls are all charged!

2. She offered us a mobile device with only 1-time payment at the moment we made the contracts. Again, I did ask repeatedly if there was any othe cost and she confirmed that no more cost associated to this mobile device were existing. From my invoice, I got to know again that this is not correct - I will be paying a mobile forever!

So, the result is that my cell phone invoice now is over 200 EUR and this is something we cannot afford, so I would like to take 2 actions:

1. I would like to raise an official compliance

2. I would like to terminate the 4 contracts

Could anyone let me know how to proceed now? Thanks.

Note.- I am only 1+ month with the contracts

All details should have been clear from the contracts that you signed at the shop. Was it an official Deutsche Telekom store or something else?

That is already two weeks over the legal revocation period (14 days).

Yes, it was the official Deutsche Telekom store in Luisenplatz, Darmstadt. And I would like to insist that the details provided were not the right ones even though we asked explicitly for them.

This is a pity! We realized when we received the invoice from Telekom

Must be a communication problem, as it is impossible to find out
who misunderstood it, it is one person's word against another's.

You have received all the contract details in the terms and conditions and the service descriptions

    1. If you are in an EU country - except the country to which the contract belongs - calls from this country to another EU country are free

Calls from Germany to other EU countries must be paid for. This is the same for all other consumer contracts from all providers

    2. No, you pay once for the phone. But you pay a higher monthly rate for the contract. This is not FOR the phone. The phone belongs to you

You can sell it at any time . Everybody should understand that you can't by a phone for 1€ with a worth of xxx€

You can only cancel the contract at the end of the 24-month period.

I got it, but this information should have been clearly explained when we asked explicitely for it in the store

I'm 100% shure that there was cleary visible the monthly cost of the contract. It is always!

That is what I mean, communication error - we can' deside who has done the mistake.

That is the Reason why AGB and  service descriptions exists - written down

Don't get me wrong, I'm not blaming you. It's just about what's left now

As far as I know, the team can't help with contracts in the shop anyway. All things have to be negotiated directly with the shop. Nothing else will come out if you write to head office.

In the shop there is no right of withdrawal anyway - this happens - if it happens - only as a goodwill gesture

Np - I don't get your wrong - you are sharing your view and the information you have and this is helpful for me! Many thanks for that

It is true that we signed off the contracts but I must admit that my German is not so good to understand all terms and conditions - this is why we made sseveral questions to the sales person and we fully trusted her. And yes, this was my mistake - I should have translated every word in the documents but I did not do it.  I thought that Telekom was not going to hide / false any information in the answers.

I was also in the shop yesterday and they mentioned that they cannot do anything, so I guess there is no goodwill gesture...

Btw, do you know if I can change the plan to another cheaper one?

I almost  guaranteed no one tried to hide anything. This kind of thing always causes more trouble than it achieves. As far as I can see, there is not a single provider whose contract conditions for international calls are different from those of Telekom.

Unfortunately, an early change to a cheaper plan will hardly be possible. Especially since a cell phone was financed with it - this would also increase the onetime  payment amounts for the cell phone
