Cancel contract: Moving into apartment with existing internet
2 years ago
How do I cancel my internet contract with Telekom since moving into an apartment which has already an internet connection? According to German Law , since December 2021, "if you move into an apartment where someone already lives and a telecommunications contract is already in place… you can terminate the contract before the end of the contract term to move out."
I have attempted to contact Telekom through their customer service but it's almost impossible to make progress there - particularly as a non-native german speaker. I have documents to prove the fact that I live in a new apartment (Anmeldung) with existing internet (internet bills) which I can provide to the relevant persons.
Would appreciate some help with this - many thanks!
Alex

This is wrong!
The law only states if the provider cannot provide service at the new location. In this case, the contractual services must be retained 1:1.
If Telekom can continue the same contract at the new place of residence, then it is their right to hold on to the contract. Simply get a 2nd telephone socket in the apartment. Only if this would not be possible, as an example because lines to the house or in the house are missing, a cancellation could become possible.

I would also add that the colleague at Telekom also confirmed this is correct while we were setting up the contract together. He mentioned that no company can force you to continue a contract to a new apartment which has an existing connection and to prove this, you can supply a proof of new residence and bills of the existing contract.

Hello @AlexThurman,
thanks for the call.
As I already mentioned, we are not forced to cancel the contract on the behalf that you are moving to a new apartment, with an already existing landline contract from a different provider. You can check either the link from the responsible government agency Bundesnetzagentur or our own Link as was posted from the user @RoadrunnerDD earlier in this thread
There is a situation in which we can cancel a contract earlier. If we can't provide you the same performance on your new address, you are entitled to an earlier cancellation. Since you did not provide me with your new address, I was not able to check if that scenario is valid in your situation.
For further question, just let us know.
Kind regards
Sana A.

Obviously I'm not going to supply my residential details on a public platform… I submitted a form with all my details yesterday so hopefully hear back from you soon.
Yes, I understand that I have a right to cancel if you are unable to provide the service at my new apartment but you are choosing to leave out the other legislation which is:
[EN]
"…if you move into an apartment in which someone already lives and a telecommunications contract already exists, you can give notice before the end of the contract period to move out since December 1st, 2021."
[DE]
This is taken from a recently published article by Verbraucherzentrale. It is communicated very clearly that my circumstance is considered a reason for termination. It was also communicated to me by a Telekom sales representative on purchase. In the meantime, I have written to Verbraucherzentrale to support me in this case.

In your case you have to select the second option.
"We first check whether we can continue to provide the service of your previous contract unchanged. Please fill out this contact form. After the check we will contact you. If we cannot provide the service, the contract ends at the desired time, but at the earliest when you move out. Otherwise, the contract ends at the end of the minimum contract period"
