Telekom fraud by door representative, making false contract forcefully

Hello Team,

In the first week of February 2024, a man claiming to be from Telekom visited my house. He said Telekom was upgrading street internet wires to fiber optic and that all Vodafone customers would be moved to Telekom. He asked for my IBAN number and requested my signature on an iPad. I signed a document titled "Ihr Auftrag für Telefonie, Internet und Fernsehen über Vertriebspartner." After they left, I googled the situation and discovered that they were scammers providing false information to get people to sign contracts with Telekom. I also called the Telekom hotline, but they requested a customer number, which I did not have at the time.

Later, I received calls from Telekom that I assumed were spam, so I did not answer them. Almost three months later, I received an email from Vodafone informing me that my contract was terminated and that Telekom was taking over my connection.

I want to bring to your attention that I did not consent to switch to Telekom. The agent falsely signed me up for a two-year contract. I went to a Telekom store to file a complaint, but they said they could not help. I also wrote an email but received no response.

On June 24, my connection was reset, and a Telekom technician set up the new connection at my home. I am unhappy with the Telekom service as it is very slow and more expensive than Vodafone.

I request that you understand my situation and terminate my contract without any additional fees or charges. I am writing to you because I have received no help from the Telekom store, hotline, or email support.

Please assist me with this Matter as soon as possible.

      You have entered into a legally binding agreement – you even had the chance to read it again.

      They were not scammers, and merely accusing them of being scammers is a criminal offense.

       

      You could have revoked the contract within 14 days of signing it – unfortunately, you did not do so.

      This is your fault, and you should not point fingers at Telekom.

       

      You also do not need to complain to Telekom; you should only blame yourself.

      Now you're paying the price for not paying attention to what you were signing.

      Additionally, you buried your head in the sand and didn't exercise your right to withdraw from the contract.

      Oh, please. Spare me the self-righteous lecture. Let's get a few things straight:

       

      First, the agent explicitly said there was no contract involved. I was told I was merely confirming his visit and the plan presentation, not signing my life away. He even took my IBAN for "future convenience" if I ever decided to go with Telekom – not to start billing me immediately.

       

      Second, how was I supposed to revoke a contract within 14 days if I didn't even know one existed? Maybe you should spend less time pretending to be a legal expert and more time understanding basic decency.

       

      Finally, if you don't know the full story, it's best you keep your misguided opinions to yourself. You have no right to blame me without knowing the facts. Save your condescension for someone who actually deserves it.

      You signed the contract on the IPAD - and for sure received the order confirmation by Mail.

      The 14 Days period is over. It is clear that you don’t want to hear  that

       

      To get help, you must go to a lawyer and file a suit - this would probably best fit your requirements of an independent help.

      Verständnisfrage:
      Bekommt man nach einem Haustürgeschäft von der Telekom eine Auftragsbestätigung mit Widerrufsbelehrung per Briefpost oder nur per Email, die als Spam o. ä. verloren gehen kann?
      Wie wird die korrekte Information über das Widerrufsrecht dokumentiert?
      Laut Verbraucherzentrale: "Wurden Verbraucher nicht korrekt über ihr Widerrufsrecht aufgeklärt, können sie es noch ein Jahr und 14 Tage lang in Anspruch nehmen."

       

      Question of understanding:
      After a doorstep selling transaction, does one receive an order confirmation with revocation instructions from Telekom by letter post or only by email, which can get lost as spam or similar?
      How is the correct information about the right of withdrawal documented?
      According to the consumer advice center: "If consumers have not been correctly informed about their right of withdrawal, they can still exercise it for one year and 14 days."

      I can understand your frustration, of course. Due to the complex malfunction, I have now initiated the expert process so that a service expert can go out and check the situation in detail. The appointment we have arranged is on Friday, 02.08.24 8am - 12pm 🙂

      the technician changed the wire in the basement electric room as he said the connection from street is not performing well in my house due to bad wire.

       

      in future, if problem persists, I will write it down here.

      I have been experiencing frequent internet disconnections since this morning, occurring approximately 5-6 times so far.

      I have noticed that the 'LINK' LED on my Speedport router keeps blinking, and it takes around 4-5 minutes for the connection to restore each time.

      Could you please look into this issue and resolve it as soon as possible?

      Hello @Amrita Singh,

       

       

      please unplug the router from the power supply and let the router restart after a power outage of at least twenty minutes.

      Please also remove any powerlines, repeaters, switches or similar.

      What does it look like then?

      If this doesn't improve the situation, I'd be happy to take a closer look at your connection.

      This requires a personal phone call. and you should be on the connection.

      When is a call appropriate?
